LOUISVILLE, Ky. — A Louisville high school’s policy on transgender students’ rights will remain in place after the Jefferson County Public School appeals board turned away objections from parents.
The board on Thursday voted 5-1 upholding Atherton High’s nondiscrimination policy.
The policy in part bars discrimination of school spaces by gender identity. In practice, that means transgender students at Atherton can use the bathroom and locker room facilities of their gender identities.
The Courier-Journal reported that the decision marks the last in the line of appeals that can be made at the district level.

Oldham County lawyer Clinton Elliott represented the group of parents upset about the policy. He had previously appealed to the school’s site-based decision council and to JCPS Superintendent Donna Hargens.
