ACLU files brief opposing Florida’s motion to dismiss marriage lawsuits


The ACLU of Florida has responded to the state’s request to dismiss the consolidated lawsuit challenging Florida’s ban on same-sex marriage.

The group said in a filing Wednesday that the request to dismiss ignores the U.S. Supreme Court’s decision last year striking down key parts of the Defense of Marriage Act, and that Florida’s ban violates equal protection under the law for the plaintiffs.

The defendants in the case include Governor Rick Scott and state Attorney General Pam Bondi.

On Friday, Bondi said in court documents that recognizing same-sex marriages performed in other states would disrupt existing marriage laws and “impose significant public harm.”
