The timing of the request means Gavin Grimm will probably not be able to use the boys’ bathroom when school resumes later this year.

Gloucester High School junior Gavin Grimm is asking the court to reverse the recent denial of an injunction that would have allowed him to use the boys’ restroom.

The U.S. Justice Department says in a court filing that transgender students must be allowed to use the restroom that corresponds with their gender identity.

The complaint stems from a new policy that requires transgender students to use restrooms according to their “biological gender.”
