N.C. AG says he supports marriage equality, but will keep defending the ban

RALEIGH, N.C. — Attorney General Roy Cooper’s office will continue to argue in court for North Carolina’s constitutional amendment prohibiting same-sex marriage, even as Virginia’s new attorney general has decided to fight his state’s gay marriage ban.

Cooper, a Democrat, previously said he supports marriage equality but wouldn’t let personal views halt his professional obligation to defend the state in a federal lawsuit seeking to negate the 2012 amendment.

Virginia Attorney General Mark Herring said Thursday his state’s amendment is unconstitutional and that he would seek to overturn it.

After that news, Cooper said in a statement that North Carolina should change its marriage law and believes basic fairness eventually will prevail.

But he says it’s still his office’s duty to make legal arguments when they exist to defend a law.

  27. His job as AG is to defend the laws of N.C. even if he disagrees. This is really stupid story. Of course we want marriage equality, but understand he has a job. As a lawyer, defense or prosecution, you take a case and your job is to win. Not to give up. It is not his place to put his personal feelings ahead of his job. If he was not a supporter of equality, and was defending the law people would accuse him of putting his personal feelings ahead of professional. Come on people, really? Understand what an AG is before posting things that are really ridiculous.

  47. This might actually be a good thing. Prop 8 was invalidated because California would not defend it, but it was invalidated VERY narrowly. Since the AG is defending it, future courts have no excuse to invalidate it on technical grounds and will be more likely to rule based on the merits. I was disappointed when Christie didn’t contest his marriage equality law, because honestly, conservatives that do this are shooting themselves in the foot, and just asking for the ruling to apply to more and more states.

    You have to look at the long term gain!

  50. Pretty sure there were AGs in other states who chose not to fight and others had to step in to defend ban. I believe that is what happened in California. The governor may appoint someone else to defend ban if this guy didn’t.
