Idaho House panel: Married same-sex couples must file taxes separately

BOISE, Idaho — Lawmakers approved a rule requiring same-sex couples who are legally married in other states but live in Idaho to file their state income taxes separately – even though they can file their federal taxes jointly.

taxesThe House Revenue and Taxation Committee made the decision Tuesday over objections from same-sex couples who said this would boost their annual tax payments, complicate filings and be a sign Idaho doesn’t respect their unions.

Republican lawmakers were joined by one Democrat, Rep. Caroline Meline of Pocatello, in backing the rule of the Idaho State Tax Commission.

The rule is now final.

The supporters said they were following Idaho’s statutes and Constitution.

However, the rule has already been singled out in a constitutional challenge in U.S. District Court seeking to topple Idaho’s 2006 gay-marriage ban.

  9. No, only the feds are required. Essentially the repeal of DOMA forces the feds to honor what the states declare to be a lawful marriage.

  11. States do not have to honor licenses granted by other states. Some licenses are honored (driving) but not all.

  13. Read section 2 of DOMA, which is still valid. Also my point is true. You can get a gun license in one state and other states do not have to recognize that license.

  14. What is your equal protection argument? (If that is why you are referring to the 14th) What federal law is the state in violation of? A marriage license is not based on federal law but state law and states do not have to honor the laws of other states. For the most part they do and reciprocate where laws are near enough to be the same but they are not required to under the equal protection clause of the 14th. If they were ALL licenses would be recognized by ALL states regardless of which state issued the license.

  15. Article IV section 1 also does not apply (full credit clause) because that only applies to judicial rulings not legislative actions.

  16. Stephen though you are right, but if the federal government comes back and states that all states have to recognize same sex marriages and even though Idaho may have a ban on SSM they must abide by the federal law. Federal Law trumps State anyday!

  17. You are right Dave and with the the Utah ban going to SCOTUS we should soon have an answer. In the DOMA and Prop 8 cases SCOTUS avoided answering the question and instead invalidated the portion of DOMA that prevented the Feds from recognizing legal acts of states (rightly decided) and punted on Prop 8 due to procedural issues. These questions need answers and too much of the "news" floating around does not do enough to educate people about the legal side of the issue. I would love to see LGBTQ Nation post a serious legal analysis article of the issue that covers all viewpoints honestly.

  28. Loving V Virginia ruling required all states to end their anti-miscegenation laws. State legislators could no longer arrest inter-racial married couples. They were FORCED to recognize the full faith and credit constitutional rights of all married couples where ever they married. Article. IV. Section. 1. Full Faith and Credit shall be given in each State to the public Acts, Records, and judicial Proceedings of every other State. And the Congress may by general Laws prescribe the Manner in which such Acts, Records and Proceedings shall be proved, and the Effect thereof. Section. 2.
