Idaho governor, GOP lawmakers pledge to defend state’s gay marriage ban

BOISE, IdahoRepublicans pledged to defend Idaho’s ban on same-sex marriage from a legal challenge, while Democrats favor letting similar cases elsewhere proceed rather than dedicating taxpayer resources to what they believe will be a losing battle.

Four couples have challenged Idaho’s gay marriage ban, enacted by voters in 2006, in federal court.

The lawsuit is the first challenge to Idaho’s constitutional ban of same-sex marriage since the U.S. Supreme Court made two key decisions bolstering the legal status of such marriages last June.

The couples, who are represented by two local attorneys and the National Center for Lesbian Rights, contend that Idaho’s laws violate the U.S. Constitution’s guarantees of equal protection and due process.

Gov. C.L. “Butch” Otter on Friday told reporters it was his responsibility to stand up for Idaho’s Constitution.

Senate GOP leader Brent Hill of Rexburg added “it’s always a wise use of funds to defend our Constitution.”

Similar ban challenges are more advanced in Utah and Ohio.

Consequently, House Minority Leader John Rusche (D) prefers letting those states lead the way.

Rusche contends fighting to preserve the bans will be a costly, losing fight, about as successful as “holding back the tide.”

It isn’t about winning; it’s about posturing for their political base. It’s a good thing Idaho is flush with cash, and had the surplus to rule at windmills while meeting the needs of its population. Oh. Wait. No it isn’t. The state regularly complains that it can’t afford to provide basic services like education and health care.

  14. I’ll ignore the Republican stance, since it’s not a surprise, and focus more on the Democrats. While I understand the “feeling” that they get about just letting the Republicans flail around at a losing battle, I still can’t help but feel they should be a part of this battle. Why stand on the sidelines when you can stand your ground and fight? It may seem like a losing battle for the Repubs, but civil rights are always worth taking an active role in the fight.

  59. 1st Amendment. Free Speech is any form of personal expression. Marriage is nothing if not a profound personal expression. It is also performance art, similarly protected.

    14th Amendment. Equal protection of the law. Equal means everyone. Not just some, EVERYONE! If any two consenting adults can marry, then any two consenting adults can marry.

    The Idaho governor should stop his pathetic pandering and start learning the law of the land.

First, every person of conscience in the US votes straight line Democrat, and given the Republicans’ redistricting and various voter suppression efforts make sure your vote is counted. Second, every gay couple in Idaho marries in a state where it is legal, returns to Idaho, and sues the pants off the state government for not following the US Constitution’s full faith and credit clause (used for interracial marriage).
