Let me explain ‘Freedom of Speech’ to all the Phil Robertson, Duck Dynasty supporters

I’m sure by now most of you have heard about Phil Robertson’s anti-gay rant he went off on during an interview with GQ magazine, and the indefinite suspension by A&E that soon followed.

And wow, this situation has sure showcased how many people just don’t understand what “freedom of speech” means. So I thought I’d explain it nice and simply to those who wrongfully believe this is some kind of attack on free speech.

You know, since apparently I wasn’t clear enough the first time. Millions of people seem unable to grasp this simple concept.

Freedom of Speech: The legal means to say almost anything you want. Meaning that as private citizens, we’re allowed to say nearly anything (with a few exceptions of course) that we want without fear of legal prosecution for it.

Unless I’ve missed something, Mr. Robertson faces no legal ramifications for what he said. That’s what freedom of speech means.

Freedom of speech does not mean we can say anything we want without ramifications for what we say from our peers or employers.

We’re free to be racist, bigoted, anti-Semitic — pretty much anything we want. We can be these things, no matter how ignorant, because that’s what the Constitution gives us the right to be.

But that doesn’t mean within a society we won’t face consequences for those “freedoms.”

The suspension of Phil Robertson is not an attack on Robertson’s right to believe how he wants. It’s a consequence from an employer for him expressing an opinion which A&E feels represents them in a negative light.

When he signed his contract, it almost certainly included a clause that says he’s a representative of A&E and is expected to act accordingly. All public figures, whether they want to be or not, are representatives of something. Be it a company, a brand, a sports team or league – it’s the price that comes along with fame.

So, yes, he was free to say what he said – and now he’s paying the consequences for it.

Just ask Alec Baldwin or Martin Bashir, two gentlemen who were fired (well, Bashir “resigned” but it’s clear he was forced to do so) for expressing their “freedom of speech” rights.

Hell, weren’t conservatives calling for Bashir’s firing? So it’s absolutely hypocritical that they’re outraged by Robertson’s suspension. Especially considering Bashir only had derogatory words for Sarah Palin whereas Robertson ignorantly bashed tens of millions of homosexuals.

And Alec Baldwin’s show was canceled for anti-LGBT remarks as well. I didn’t see many conservatives up in arms about that — but clearly it’s all about whose ox is being gored now, isn’t it?

So once again, we are given the freedom of speech to say almost anything we want without legal ramifications for those words. But that does not mean that there aren’t any ramifications for what we have the freedom to say.

Until Mr. Robertson gets thrown in jail for saying what he said, his supporters need to stop crying about this being an “attack on free speech.” Because when they do, they obviously prove how ignorant they are about what “freedom of speech” really means.

  8. Yet if A&E fired him for supporting gay rights this whole page would yelp and hollar about freedom of speech and bigotry. Then people wonder why despite being bisexual and dating a guy I stay the hell away from most things in the gay community….its because I cant stand the double standard bullshit thats tossed around.

  11. I didnt say everyone does it Zack but look at this page too many people do it. Actually the majority do it. I am a conservative and give those people hell for double standards too. I figure someone has to scream their head off about what real liberty is and since my interests are both in the conservative and gay communities its up to me to do it. Frankly I am liberatarian in nature but since most people are too damn dumb to not vote on party lines im best off fighting from within the conservative groups to moderate them and the same goes for groups like this.

  13. This controversy has done very little to moderate the conservative movement. Go to GLAAD's Facebook page and read the absolute spewing of hatred occurring there. And yes, not opinions, but vile and repugnant comments towards the LGBT community. This issue has further divided America, and shown quite clearly those who scream the loudest usually know the least. The 1st Amendment does not protect against consequences, you and me both know this.

Fact is that Christians and religions in general have taken a beating over the last few years despite some of them being staunch allies of the lgbt community. Combine that with the fact that too many people want to censor every little thing that hurts their pathetic feelings and we wonder why this nation is splitting at the seams. Well that with the lack of actual education and expectations for self reliance and we have the crap stew that the world is mired in. If people dont start shutting of the TV learning to provide for themselves and learning to live and let live we are going to see some ugly crap. If you look at the world right now we are on the down turn that destroyed Rome and other great cultures. Who knows what will replace things if we let it hit the point of no return.

  15. Daniel, I agree, but I question people calling this a double standard when the LGBT community has yet to turn this apparent "intolerance of Christians" into public policy. Are we putting ballot referendums up to take away Christians right to marry? Are we demanding legislation closing churches? Are we actively working against Christians by claiming they have a disease that is to be cured? No, no, and no. This is not about a loss of liberty or freedom, but a disagreement of faith, which is not some kind of unquestionable attribute in our society. Once a catalyst is given to those who routinely and actively work against LGBT people in the public sphere, they will pounce on it, further wishing to write discrimination into the minds of children and the constitutions of our states. I was not offended by Phil's comments, I have friends who feel the same way and do not judge, but the sudden disbelief in freedom of association by those on the right and the hatred that has inexplicably come with it is further isolated independents like me from the conservative movement. Hypocrites exist on both sides, there is no doubt, but if I am to submerge myself in a movement that is backed by hypocrisy, then I would prefer it be one who does not actively work against my very existence.

  16. Zack I can understand that. However think about how the LGBT community has pounced on the slightest hint that a person disagrees with us. They often wish to silence all opposition from the public realm and brand it "hate speech". I will fight tooth and nail against such crap. My neighbor could say "good morning faggot" every day I walk out my door and I wouldnt care one bit but the moment he tried to lay a finger on me or use the law to restrict my liberty then we would have a serious issue. The LGBT political movement is wasting precious time and energy on crap that doesnt affect us one bit. That is time, energy, and money that could be spent furthering civil liberties, or teaching lgbt youth self defense (which we desperately need a movement for) or how about we take these community centers of ours and use them to offer classes for personal development. I mean damn it how many LGBT people can stand on the grounds of SERIOUS achievement and say piss off look at what I give the world. Its damn hard to fight against people that are actually benefiting the world. But instead we have this waste of time and resources on crap like Phil Robertsons opinions and a serious "Peter Pan syndrome"

It does not come as a surprise to me that people get offended when something that makes up their very existence is labeled as an abnormality, a facet of themselves that prevents them from entering into Heaven. We must learn to tackle comments like Phil's with reason and common sense, not pure emotion, as is completely evident by his supporters. It is only through such discussion that acceptance of the LGBT movement will grow.

For crying out loud he’s a “redneck” I DO NOT agree with what he said but he has a RIGHT to his opinion. Dont like it??? Grow up !!! and change the channel for 30 min.   27. Dont get me wrong!!!... I think he is an old Christian redneck and nothing worse than what he said. If "God" is all loving then imo everyone will be granted into heaven. Im talking in general. Its not about beliefs, its about the way you are born, until ppl like him understand this there will be no understanding. I just think ppl complain and place blame at the wrong place.   41. If Mr. Robertson violated the terms of his contract with A&E by saying something in an interview with GQ that brought them negative publicity, then they were within their legal rights to suspend him indefinitely or terminate his contract. Ever hear of the term "at will" employment?

  45. This has nothing to do with an opinion, Adelle. It has to do with Phil violating A&E's decency clause, which means he improperly represented his employer, and A&E chose to suspend him for that. It has zero to do with religion, or freedom of speech, or if what he said was offensive to anybody. If you or anybody else decided to be seen in a television interview in your work uniform which identified you as an employee of a certain business, and you said something that your bosses felt wasn't proper for an employee to be saying while wearing the business logo, they could fire you for that. It's just that simple. No religious attack, nobody taking anybody's freedom of speech, nothing illegal. You can accuse others of being stupid all you like, Adelle, but your own obvious lack of comprehension seems to speak volumes. Have a nice day, and Merry Christmas. :)

  46. Reading the comments above. Do any of you realize that his "opinion" is the opinion that has caused so much death in our community? People in the closet hear this about LGBT individuals and think they are worthless which can lead to suicide. This "opinion" leads other to think that we are second class with no right to equality. This "opinion" leads others to commit violent acts on LGBT community members. When no more LGBT teenagers kill themselves, or LGBT people are beaten to death because of this "opinion" then maybe it wont matter any more. He is not having his first amendment rights violated when we complain. The fact that we are not allowed to complain...that is the violation of free speech.

  48. Many people judging Phil on his appearance, is this how you want people to treat you? Judge you before you even speak. Phil was asked what he thought sins were, so he listed them, he did not compare anyone to anything. To my knowledge no other group is upset that their actions are considered sinful in a book (murderers have been silent, drunks have been silent, pagans are silent etc...). They shrug it off and carry on with their life. He didn't direct any comments to anyone or group directly, nor did he call for action against anyone. unlike a democrat talking head who with hatred for someone, went on television and said someone needs to assault this person and defecate down her throat - this is wrong and he was not fired but was allowed to resign. As for racist comments: Phil described what the families were like that lived around him and that he worked beside, they were godly, good family values and happy people. I too grew up near a black family (I say black because I don't want to offend any Haitian people, not all black people are from Africa) in the early 70's and we were poor and they were poor but they, like my family, attended church, were a close family with good values and were happy people. Am I racist for having that memory? I'm in the north, not the south (New Hampshire) and my family fought to free the slaves. I'm also the great, great grandson of a Native American Chief - want to discuss discrimination. Just because you have the right to do something, doesn't mean it's the right thing to do! And with that said, A&E had a choice and went against the majority of their viewers (wrong move). Promoting censorship of one's beliefs or opinions is a dangerous slide to get on. The solution here is real simple: change the channel (LOTS of crap out there to watch), don't support the magazine.. it's that simple, don't complicate the the simple things in life.   78. I’m gay and I honestly was not offended by what he said. This whole thing got blown up. I’ve seen just as much hate and “bashing” come from our side as I have from their side. Really if you are going to disagree with my life style I’d rather it be done in the way he did it than in others ways it has been done. What about salvation army calling for our death and that of our parents? No one made a huge deal out of that. At least this guy got the Christian party right by saying he didn’t agree but doesn’t judge and still loves everyone. I in no way am condoning being discriminated against or hatred on. However sine if the responses I’ve seen cine from my community have been no better if not worse in the hateful area. The whole situation makes me sad why can’t we just let people live their lives?

  85. I look at it a bit differently. I'm not offended by his opinion, because as they say, opinions are like butts, everyone has one, and it doesn't mean that you're opinion is right. BUT, I agree with A&E here. A&E acts as his EMPLOYER. If I went in Publix, CVS, Walmart, or anywhere else that I've worked and said something like that against someone, regardless of race, gender, sexual orientation, appearance, etc, I would have been suspended too, if I wasn't fired. I agree that he deserves freedom of speech, but A&E as his employer has the right to suspend/fire him. Just saying.

    Note that I’m not disagreeing with the author of the article at all. I just don’t believe that this is an issue of freedom of speech, nor do I believe that it was an unplanned mistake on Robertson’s part. I think it was wholly planned.

If you raise the number to include occasional or incidental homosexuality or rises to around 10%. When you multiply that number by the few hundred million adults in the US you can get the tens of millions estimate.

For his comments on black people? My perspective, though I could be wrong, is he was strictly talking about his experience. It was not a comment on the entire race.

A & E might have the right to pull the plug, and GLAAD certainly had the right to complain about what was said, but viewers of the show who shop the sponsors and enjoy the show also have the right to complain about A & E’s choices. They have the right to stand up and say “We agree with Phil Robertson, and we’re going to show that agreement by buying his merchandise and watching his show. And we’re going to show our disapproval of A & E’s decision by refusing to purchase their merchandise or watch their shows.” Then it’s up to A & E to see exactly how much is on the line and choose either to keep their highest rated show or not. If not, maybe another network will listen to those people who are outraged that once again a minority has overturned something they enjoy simply because they didn’t like what was said and chose to get offended by someone’s personal opinion and religious beliefs. If not, oh well. The rest of you can continue to yell as loud as you want that Mr. Robertson got what he deserved and shouldn’t be allowed to do whatever, but I’m willing to lay odds that NONE of you have ever actually watched the show. In which case, I feel you need to keep silent.

  299. I’m tired of people like Robertson, but I’m not willing to narrow the scope of what “Freedom of Speech” really means. Seems that people narrow it to infringements by the federal government, but some big corporations have GDP that are larger than some small to mid size nations, and I would hope that those entities value free speech as well. Freedom of speech is not absolute. Words can hurt people. Words can appeal to people’s emotions and galvanize undue prejudices. Sometimes consequences must ensue. I appreciate that A&E stands up for LGBT, and I’m glad they could understand the pain inflicted on LGBT by people like Robertson throughout history. They had a tough decision to make, and maybe Robertson will need to become a televangelist, but A&E is not in that business.

But since a straight man answered a question truthfully, which is commendable within itself, he’s the target of every person who wishes to pin another slur on him. You can not say you are going to harm the president. There are many other occasions where freedom of speech is limited. The whole reason for the scripture he recited is to showcase Gods enormous love and forgiveness package. Unfortunately everybody seems to recite that same scripture in a way the is meant to harm others. To recite it without the next passage is truly evil and works for harm. NEVER PREACH OR TEACH 1 Corinthians 6:9-10. It is a devil trick to make people believe they can not be saved and go to heaven and since they don’t believe and or receive Christ because of that unbelief, they will go to hell. But even in the comment in this post there have been hateful remarks. So how is that any different than what you are saying they did. Personally I was much more offended by the salvation army’s comments on putting us to death but that’s just me. There is hate on both sides. Things like this just fuel the fire.     You say you don’t hate gay people, BUT at the same time you don’t want us to be happy (unless we can achieve that happiness by being straight) which is impossible since sexuality is something you are born with and not chosen.     Jesus didn’t judge people, Jesus didn’t complain about helping the poor and hungry (food stamps), and Jesus didn’t preach hate. Jesus would have wanted us to do everything in our power to help the sick (universal healthcare), and Jesus sure as hell wouldn’t be condemning people he had never met. Last time I checked divorce, pre-marital sex, vanity, and having babies out of wedlock were all sins, yet I don’t see you condemning them daily or trying to take those sinners rights away. In fact, most of you ARE those sinners. You are hypocrites. Shame on you!

    It’s one thing to spread the word of God, but it’s another thing to act like Nazis while doing it. Expecting everyone to live under laws based on your personal faith makes you no better than the dictators in the countries we are trying to “liberate”.

    Let me remind you that even though the Bible was written by God through man, man makes mistakes! I personally do not believe God, who’s overall message was unconditional love, compassion, and that all men are created equal would ever say things like: “Slaves, obey your earthly masters with fear and trembling, with a sincere heart, as you would Christ.” (Ephesians 6:5) or “I do not permit a woman to teach or to have authority over a man. She must be quiet.” (1 Timothy 2:12). I mean come on, really? How can you not see that this once Sacred and Holy book was obviously changed (numerous times) throughout history to fit what the rulers of that time believed and was also used as a way to scare people into conforming? Wake up! God gave us Free Will to decide between right and wrong and in my personal opinion, slavery and oppressing women is wrong. If those verses aren’t God’s word how could anyone say with 100% certainty that being gay isn’t a part of his plan. And even if it wasn’t who are you to impose Gods will on others?

    Lastly, I don’t need you to tell me what God wants, I talk to him everyday. I will always believe in Jesus Christ. He will always be my Lord and Savior. Your hate will NEVER take that away from me. But I renounce being a “Christian” under your misguided standards any longer. I was born homosexual and the God I love and believe in doesn’t make mistakes. The God I love and believe in created everyone EQUAL.

  372. Sure, he has freedom of speech. HOWEVER, A&E acts as his EMPLOYER. If I went in Publix, CVS, Walmart, or anywhere else that I’ve worked and said something like that against someone, regardless of race, gender, sexual orientation, appearance, etc, I would have been suspended too, if I wasn’t fired. I agree that he deserves freedom of speech, but A&E as his employer has the right to suspend/fire him. Just saying.

  389. Okay, I don’t agree with what he said either, but many people from both sides have been blowing this way out of proportion. For starters, he often expresses his opinions, including those regarding his religion. No one should be even remotely surprised that he continued to do so. A&E was in the wrong for suspending him because they did it BECAUSE OF THIS INTERVIEW which means that they were basing the suspension off of his religion which is against the equal rights act. Meaning legally they couldn’t actually suspend him for that, but they did.

    Anyways, more to the point: many people are complaining about what he said or people who support him, and many are (obviously) supporting him in what he said. I’d just like to point out that though he did say that he thinks it makes more sense for a man to be attracted to a woman than to a man, he still loves everyone regardless of whatever their sins may be and he won’t judge anyone because that’s Jesus’ job to do in the afterlife (which, if you read the Bible in the Gospel of Matthew I believe, it is actually distinctly stated that no one on Earth has the right to judge one another, so that’s actually right by Christianity). So he may have said he doesn’t agree with homosexuality, but he still loves everyone equally and doesn’t judge anyone. No one should be getting as worked up as they are over this. Believe me, as someone who is bi with relatives that fall on both ends of the spectrum in terms of their opinions on what Phil said, I think the arguing is pointless because they’re taking it all out of context anyways.

  392. Gillian your last several post are hateful and intolerant so how are you any different. I don’t agree with what he said but he still has every right to feel that way. At least he is not calling people names add you are right now. I stand up to my way off life and who I am on a daily bases. I think how some of us handle the situation causes us to not get through to people who may not understand. Just as a gay women may think yuk at the thought of being with a man some straight people feel the same way. I’ve changed many minds and had the opportunity to discuss my side because I didn’t get hateful with anyone as you are. You cannot fight fire with fire. People are much more willing to listen when you are respectful even when they are not deserving of it. So please rethink your hatefulness you may find it easier to get through to people. I’m not trying to change the mind of someone not willing to listen but I may get through to someone standing by watching how I handle the situation. If we are going to get mad about hateful comments then we cannot be hateful back or you will make no progress.
